PopHood — Terms of Service

Please read these Terms of Service ("Terms") carefully before using PopHood — Mobile Mechanic Pro ("PopHood," "the App") operated by VertexLab Solutions ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using PopHood, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

PopHood is a business management tool designed for mobile mechanics and automotive service professionals. The App provides:

• Job scheduling and management
• Customer and vehicle tracking
• Invoice generation (PDF)
• Mileage tracking for tax deductions
• VIN scanning and vehicle identification
• Voice-to-invoice dictation
• Business reporting and data export

3. Accounts & Registration

PopHood does not require account creation or registration. Your data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App.

4. Subscriptions & Payment

• Free Tier: PopHood offers core features at no cost with usage limits (5 active jobs, 10 customers, 3 invoices/month).
• PopHood Pro: An optional subscription that unlocks unlimited access to all features.
• Pricing: Monthly ($7.99/month) or Annual ($49.99/year), both with a 7-day free trial.
• Billing: All payments are processed by Apple through your Apple ID. We do not handle any payment information directly.
• Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your Apple ID Account Settings (Settings > [Your Name] > Subscriptions).
• Refunds: Refund requests are handled by Apple per their refund policy.
• Free Trial: If you cancel during the 7-day free trial, you will not be charged. If you do not cancel, you will be charged the subscription price at the end of the trial period.

5. Acceptable Use

You agree to use PopHood only for lawful business purposes. You shall not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Attempt to access features or services without proper subscription
• Use the App to store or transmit malicious content
• Resell or redistribute the App or its services

6. Your Data

• Ownership: You retain full ownership of all data you enter into PopHood (business info, customer records, invoices, photos, mileage logs).
• Local Storage: Your data is stored on your device and is not transmitted to our servers.
• Backup: You are responsible for backing up your data. We recommend enabling iCloud backup on your device.
• Export: PopHood Pro allows you to export your data as CSV files at any time.
• Deletion: Uninstalling the App permanently deletes all locally stored data.

7. Invoices & Financial Data

PopHood helps you generate invoices and track payments. However:

• PopHood is not a certified accounting software.
• You are responsible for the accuracy of all financial data, tax calculations, and invoices generated.
• We recommend consulting a professional accountant for tax filing and compliance.
• Mileage deduction estimates are for informational purposes only and should be verified with a tax professional.

8. Intellectual Property

The App, including its design, code, features, and branding, is owned by VertexLab Solutions and is protected by copyright and intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App.

9. Disclaimer of Warranties

PopHood is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• VIN scanning or voice recognition will be 100% accurate
• Mileage tracking or GPS location will be perfectly precise
• Generated invoices meet all local regulatory requirements

10. Limitation of Liability

To the maximum extent permitted by law, VertexLab Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of PopHood.

11. Indemnification

You agree to indemnify and hold harmless VertexLab Solutions from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause. Upon termination, your right to use the App ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
